Bosnia's Constitutional Court finds restriction of movement unconstitutional

Bosnia's Constitutional Court found the restriction of movement to youths under the age of 16 and persons over the age of 65 unconstitutional and in violation of human rights, the Court said Wednesday after several individuals filed a complaint against the measure imposed by Federation (FBiH) entity authorities to fight the spread of the Covid-10 pandemic.

“The Constitutional Court found that the disputed orders of the FBiH Civil Protection Headquarters ordering the ban of movement to persons under the age of 18 and over 65 in the FBiH violated the right to freedom of movement guaranteed by the Constitution of Bosnia and Herzegovina as well as their human rights guaranteed by the European Convention on Human Rights,” the Court said.

The Court ordered the FBiH government and the FBiH Civil Protection Headquarters to their measures with this decision within five days after receiving it.

The Court made a decision after several citizens appealed against the said measures, arguing it encroached on their human rights.
