BiH Court says concession for HPP Buk Bijela must be resolved in three months

The BiH Constitutional Court issued a partial decision Friday on admissibility and merits at the request of 24 Bosnian MPs on the concession for the hydroelectric power plant (HPP) Buk Bijela.

According to RTRS, the BiH Concessions Commission was tasked with resolving the disputed issues between BiH and the Republika Srpska (RS) entity regarding the award of concessions within three months.

The MPs asked that the RS’ decision granting a concession for the construction of the HPP on the Upper Drina river be revoked. The appeal states that decisions regarding state property, such as rivers at international borders, can only be made at the BiH level.

They addressed the Constitutional Court in December last year for what they called a violation of the sovereignty of BiH. They asked the Court to comment on the decision of the RS Government on determining the conditions for the award of concessions for the construction and use of HPPs on the Drina River, in the municipality of Foca.

Despite the appeal, but also the clear position of the Attorney General's Office that the state could not be bypassed, the cornerstone was laid in mid-May this year in Foca for the construction of the Buk Bijela HPP.

The Prime Minister of Serbia, the country investor in the project, said then there was nothing disputable in the construction of the Buk Bijela HPP because the lawyers have reviewed everything, concessions have been awarded earlier and there has never been a problem. The RS Prime Minister was even more direct saying it is the territory of the RS and that BiH has nothing to do with it.
