BiH Presidency Chair tells FM to act according to UN Charter regarding Ukraine

The Chairman of Bosnia’s tripartite Presidency, Zeljko Komsic, instructed the country’s Foreign Affairs Minister to act per the UN Charter regarding the war in Ukraine, arguing that since BiH is a signatory of that document a special decision of the Presidency on the matter is unnecessary.

The Bosnian Croat Presidency member has, along with the Bosniak member of the institution, Sefik Dzaferovic, condemned Russia’s invasion of Ukraine. However, their Bosnian Serb colleague in the institution, Milorad Dodik, did not do so and rejected the idea of BiH joining the EU’s sanctions against Russia.

Komsic pointed out that Bosnia and Herzegovina is a member of the United Nations and a signatory of the UN Charter, which explicitly prohibits attacks on internationally recognized UN member states as well as military activities directed against member states without the consent of the UN Security Council.

“Therefore, I consider it unnecessary for the Presidency of Bosnia and Herzegovina to declare and vote on the application of basic principles of international law defined in the UN Charter, which we are signatories to and which have been in force since 1945 and represent the civilizational achievements of the modern world,” Komsic said.

He also noted that the Stabilization and Association Agreement between BiH and the European Union and its Member States states that Bosnia and Herzegovina is obliged to take steps to promote common positions on security and stability in Europe, including cooperation in areas covered by the European Union's Common Foreign and Security Policy.

He then pointed out the basic principles of BiH’s Foreign Policy Strategy.

“Bosnia and Herzegovina, through the implementation of its foreign policy goals, should act in accordance with the obligations arising from concluded and accepted agreements and other international instruments, as well as membership in international organisations and associations,” he stressed.

“I believe that the vote in the Presidency of Bosnia and Herzegovina, on whether or not Bosnia and Herzegovina should fulfil the international obligations it undertook by signing the cited international acts, is therefore unnecessary. I suggest that in its further activities on the issue of the aggression against Ukraine, the Ministry of Foreign Affairs of BiH be guided by the mentioned principles of international law, which are unquestionable,” he wrote.

Komsic also noted that BiH has already joined the positions of the European Union on the issue in the United Nations, as well as that the country supported the suspension of the Russian Federation from the Council of Europe.

“Accordingly, the views of Bosnia and Herzegovina have already been expressed by the heads of missions of Bosnia and Herzegovina to the United Nations in New York and the Council of Europe in Strasbourg,” he added.
