Dodik, the new RS entity president: We won't remain in an unconstitutional BiH

The new President of Bosnia's Republika Srpska (RS) entity, Milorad Dodik, who until Wednesday served as one of BiH’s three Presidency members, said that all post-war reforms which led to the creation of state-level institutions were imposed and should be “on the table” again, arguing that a referendum on the BiH Court and Prosecutor’s Office should be organised in the RS entity.

Dodik is taking over the RS President post from Zeljka Cvijanovic, a member of his Alliance of Independent Social Democrats (SNSD). Cvijanovic on Wednesday took over Dodik’s previous post in the BiH Presidency.

“All institutions and the whole of Bosnia and Herzegovina are captured by the spin that comes from political Sarajevo, from their political representatives, and I could see that even today. Just a few minutes before they swear to the Constitution and the Dayton Agreement, and then later in their inaugural speech they say something completely opposite,” he said, stressing that this especially refers to the Bosnian Croat in the Presidency, Zeljko Komsic.

“That's how he spoke about his past work in the Presidency and tried to maintain a spin that doesn't exist, which is NATO. BiH does not have a single decision stating that it is a member of NATO or that it will be. There is some program of reforms. A few days ago, there was a representative of NATO in Sarajevo who said that each country is independent in this respect and that it is the political will of each country whether to join NATO or not,” added Dodik.

He continued strongly criticising the BiH Presidency, saying that Cvijanovic will soon find out how it operates.

“They destroyed the Intelligence Agency, none of the systems provided for by the Constitution are functioning, they falsely swear by the Constitution, and after that everything they say is anti-constitutional,” he said.

Dodik said that all the post-war reforms in BiH were imposed and should be “on the table” again.

“The Court and the Prosecutor's Office do not have a constitutional basis, they were imposed by the High Representative, the rules corresponding to them are incorporated in the Annexes. The RS is not against agreeing on some form of Court and Prosecutor's Office, but we will not tolerate this Court and Prosecutor's Office,” he said, as he announced that a referendum on the issue will be organised in Bosnia’s Republika Srpska (RS) entity.

“We will try to create a configuration in the Republika Srpska that will allow all our important decisions to pass and will be passed by the necessary qualified majorities. We intend to change the constitution in RS. We will do many things to improve the condition and functioning,” he said.

“We will not remain in unconstitutional BiH, we will do everything to prevent it from remaining so. We were always told that when we reach candidate status, even the Venice Commission determined in 2005 that the European path with foreign judges and the High Representative was inappropriate. They violate all that, and they try to sell us again some packages that don't mean anything or contribute anything,” he said.

Dodik said that the main focus of officials from the RS in state institutions will be on the entity.

“We are completely tired of trying to organize Bosnia and Herzegovina as a community for all. The political peoples here are Bosniaks, Serbs, Croats and they are expressed through the political system in the manner provided by the Constitution. That same Dayton Agreement and the Constitution were written as a result of the agreement on the political system in Bosnia and Herzegovina that stopped the war. It has been desecrated by high representatives in the past, and now in recent times, it has been changed by foreign judges of the Constitutional Court and Muslims (the term Dodik often uses to refer to Bosniaks) who vote with them. No one has to expect that we will accept it, we will refuse. If they expel us from BiH, we will leave it ourselves”, he said.
