DPC welcomes Schmidt's decision, asks whether OHR will change approach to BiH

The Democratization Policy Council welcomed the use of the Bonn Powers by High Representative Christian Schmidt in Bosnia and Herzegovina, on Tuesday, to suspend Republika Srpska’s property law, which was a direct attack on the constitutional and the rule of law order enshrined in the Dayton accords.

They also welcomed the fact that Schmidt’s move was backed by the US, the UK and the EU.

“Any move to undermine the integrity of Bosnia and Herzegovina’s constitutional order needs to be decisively countered by the West; it has been the failure to do so that has led to reform regression, mass exodus of talent and the current threat to the country’s integrity,” they said.

However, the DPC asked what the broader strategy behind the High Representative’s use of the Bonn Powers was and whether there will be any concrete steps in case the RS continues to ignore the OHR’s decisions and court rulings on the property issue?

“Does it signal a more robust international posture vis-à-vis Dayton violations, or is this a one-off since the violation was too blatant to overlook? And finally, will this be matched by a recalibrated approach to BiH’s challenges, which for the past 2 years have been dominated by a race to the bottom deal-making that have entrenched anti-reform spoilers,” the Council asked.

If so then Schmidt could finally be demonstrating he knows what his job needs to entail, they concluded.

The High Representative in BiH suspended the RS entity Law on Immovable Property which allowed the entity to dispose of the country’s resources such as forests, rivers etc., without the approval of the State.
