OHR: Incumbent Sarajevo authorities should perform duties until new ones elected

The incumbent Sarajevo authorities should continue performing their duties until their successors are ensured and their election is passed by the City Council, the Office of the High Representative told N1 Tuesday.

Given that the incumbent Mayor of Sarajevo Abdullah Skaka and the newly elected Chairman of the Sarajevo City Council come from the same people, N1 asked the Office of the High Representative which oversees the civilian implementation of the Dayton Peace Agreement that ended the war in Bosnia, to interpret the new situation.

“Unfortunately, the newly elected Sarajevo City Council did not immediately elect a new Mayor, when it began holding its constituent session on March 24. Mr Bogic Bogicevic, with an exceptional reputation as a man and as a politician, which transcends the borders of this region, was a candidate of unique qualifications for this position and we regret that his candidacy was withdrawn,” the OHR told N1.

“In any case, the OHR continues to believe – and has previously informed the Sarajevo City Administration of this position – that, as there are no provisions explicitly defining the opposite solution, the principle should apply that the incumbent authorities should continue to perform the duties entrusted to them until they are replaced by someone else.

The principle of continuity in the performance of public functions stems from the fact that the continuous functioning of the executive power and the performance of its functions in the city of Sarajevo, as a unit of local self-government, must be ensured. This authority should be rarely used and it should address only those issues that are necessary for the day-to-day functioning of the city administration or for procedures without which the city of Sarajevo would face harmful consequences,” the OHR told N1.

According to the Rules of Procedure, the Mayor of Sarajevo and the Chairman of the City Council cannot be members of the same constituent people, which is currently the case, after Bogić Bogićević withdrew his candidacy, but was still unanimously elected at the last session of the City Council. Regardless of his decision to pull out from the race, councillors decided to vote and elected him as Abdulah Skaka’s successor.
