Presidency Chairman Dzaferovic tells Schmidt his decisions against Court ruling

The Chairman of Bosnia's tripartite Presidency, Sefik Dzaferovic, spoke with the High Representative of the international community in Bosnia and Herzegovina, Christian Schmidt, on Wednesday about the amendments to the Constitution of the Federation (FBiH) entity and the Election Law, imposed by Schmidt’s decision, Anadolu Agency reported.

“Chairman Dzaferovic said that the mentioned amendments are in accordance with the demands of only one political party for changes to the FBiH Constitution and electoral legislation. Chairman DZaferovic said that according to the Dayton Peace Agreement, the High Representative has the authority to change laws and entity constitutions, but he opposes the content of the aforementioned changes, because they are not in accordance with the Constitutional Court's ruling on the constituency of peoples on the entire territory of BiH, nor with the principles of the European Court on Human Rights rulings. He also pointed out that according to the aforementioned amendments, the asymmetry between the two entities has deepened, when it comes to the protection of the rights of the constituent peoples, their representation and decision-making methods,” Dzaferovic's cabinet announced, adding that:

“Dzaferovic pointed out that the constituent peoples must have the same rights in both entities, which is not ensured by Schmidt's amendments because the constituent peoples have one status in the FBiH and another in the Republika Srpska (RS) entity. Dzaferovic pointed out that vice-presidents of the RS entity, unlike in the FBiH, have no influence in the process of forming the Government and election of judges of the Constitutional Court of that entity.”

The two also discussed the future of BiH, the preservation of stability and peace, based on the Dayton Agreement and 27 years of its implementation, as well as the European path of the country, in the context of the European Commission's Report on the progress of BiH.
