Sarajevo Canton Assembly passes Resolution on Prevention of Sexual Harassment

The Sarajevo Canton Assembly adopted a Resolution on the Prevention of Sexual Harassment, Wednesday, asking the government to pass a number of laws banning harassment on bases of gender, sexual orientation or any other form of sexual violence.

“Sexual harassment and violence are the most common forms of sexually oriented violence, which is most easily tolerated and for which our legislation does not have an adequate sanctioning mechanism. The same includes unwanted sexual behaviours that do not necessarily involve physical contact, and place the person in an awkward and humiliating position, causing a sense of shame,” the Resolution said.

The resolution further points out that the key aspect of this type of harassment and violence is power because it is often carried out by a person who is in a more powerful position than the person over whom it is carried out, which leads to a situation of sexual harassment, i.e. blackmailing which legitimizes itself as a tool for exercising power and influence.

“Sexual harassment is often treated as a trivial problem that can be easily avoided and stopped, which is usually not true. Very often, these are repetitive behaviours that occur over a long period and for which the victim cannot find a systemic solution. Precisely because the victim cannot receive adequate support from the system, society in a certain part resorts to equalizing the role of the perpetrator and the victim,” the Resolution states, adding that “in that sense, we, the elected representatives of the citizens of Sarajevo Canton, oblige the Government of Sarajevo Canton, in cooperation with experts from relevant fields, to prepare and submit the following to the Assembly of Sarajevo Canton, in an urgent procedure, for adoption:

– Draft Law on Prevention and Prohibition of Gender-Based Harassment and Sexual Harassment and Violence in Sarajevo Canton;

– Draft Rulebook on Rules of Conduct of Employers and Employees Regarding Prevention and Protection against Harassment at Work in Sarajevo Canton;

– Draft Protocol on Action in Cases of Reported Harassment Based on Gender and Sexual Harassment and Violence in Sarajevo Canton;

– Draft of Decision on mandatory adoption of unified codes of ethics in all public companies, institutions, institutes and funds established by Sarajevo Canton and/or bodies of local self-government units or majority-owned by Sarajevo Canton and/or bodies of local self-government units, which are harmonized with the Protocol;

– Draft Action Plan for Prevention and Suppression of Gender-Based Harassment and Sexual Harassment and Violence in Sarajevo Canton;

– Draft Decision on mandatory annual reporting on compliance with the obligations prescribed by the Law on Gender Equality as part of the annual work reports of all public companies, institutions, institutes and funds established by the Sarajevo Canton and/or bodies of local self-government units or which are majority-owned by the Sarajevo Canton and/or bodies of local self-government units,” the Resolution states.
